Please read these Terms and Conditions carefully before placing an order or using this website. By accessing our website or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use this website.
These Terms are governed by the laws of South Australia, Australia and the Australian Consumer Law (ACL). Nothing in these Terms limits or excludes any rights you have under the ACL that cannot be excluded.

2. Acceptance of Terms
By browsing our website, creating an account, or completing a purchase, you confirm that you are at least 18 years of age (or have parental consent), and that the information you provide is accurate, current, and complete.
We reserve the right to update these Terms at any time. The version in force at the time of your order is the version that applies to that order. Continued use of the website after an update constitutes acceptance of the revised Terms.
3. Orders and Contract Formation
Placing an order constitutes an offer by you to purchase the product at the price shown. A binding contract is formed only when we send you an order confirmation email. We reserve the right to decline or cancel any order at our discretion, including where:
- A product is out of stock or discontinued after the order is placed
- A pricing error exists on the listing
- We suspect fraudulent or unauthorised activity
- Payment is not successfully processed
If we cancel your order, we will provide a full refund to your original payment method within 5 business days.
4. Pricing and Payment
All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable. Shipping costs are calculated at checkout and shown before you confirm payment.
We reserve the right to correct pricing errors. If the correct price is higher than the displayed price, we will contact you before processing your order. You will have the choice to proceed at the correct price or cancel the order for a full refund.
Payments are processed securely by Stripe. We do not store your full payment card details. By providing payment details, you confirm you are authorised to use that payment method.
5. Products and Descriptions
We make every effort to accurately describe and photograph our products. However, colours may appear differently depending on your screen settings. Minor variations between product photos and the physical item are not considered defects.
For our stainless steel fashion jewellery, dimensions, weights, and finish may have minor production tolerances. These tolerances are standard in the industry and do not constitute a fault.
6. Custom and Bespoke Orders
Custom jewellery orders are subject to separate terms agreed in writing at the time of commission, including design specifications, pricing, timelines, and deposit requirements. These Terms apply to custom orders in addition to those specific terms.
Custom pieces are made to your specifications. We will provide design sketches or renders for your approval before commencing production. Once you have approved the design in writing, changes cannot be accommodated without additional cost and delay.
A non-refundable deposit (typically 50%) is required before we commence work on a custom order. The deposit covers design, sourcing, and labour costs incurred up to that point. If you cancel after approving a design, the deposit is forfeited. This does not affect your ACL rights where the item is faulty or not as agreed.
7. Returns and Refunds
Our returns and refunds policy is set out in our Returns & Refunds Policy, which forms part of these Terms. We do not accept change-of-mind returns. Your rights under the ACL are not affected.
8. Shipping and Delivery
Our shipping terms are set out in our Shipping Policy, which forms part of these Terms. Risk of loss and title for items purchased passes to you upon delivery to the carrier.
You are responsible for providing an accurate delivery address. We are not liable for non-delivery caused by an incorrect address you provided.
9. Intellectual Property
All content on this website — including text, photographs, graphics, logos, product designs, and the website's overall look and feel — is owned by or licensed to Stratum Stone and is protected by Australian and international copyright law.
You may not reproduce, distribute, modify, transmit, republish, or use any content from this website for commercial purposes without our prior written consent. Personal, non-commercial use is permitted provided you do not remove copyright notices.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or relating to these Terms or your use of our website or products is limited to the amount you paid for the product giving rise to the claim.
We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profits, loss of data, or loss of opportunity, arising from your use of our website or products, even if we have been advised of the possibility of such loss.
We do not exclude or limit any liability that cannot be excluded under the ACL, including liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
11. Website Use and Availability
We do not warrant that this website will be available at all times, free from errors or viruses, or that it will meet your requirements. We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice.
You agree not to use this website for any unlawful purpose, to transmit any harmful or offensive content, or to attempt to gain unauthorised access to any part of the website or its infrastructure.

This website may contain links to third-party websites. These links are provided for your convenience only. We have no control over, and take no responsibility for, the content or privacy practices of third-party sites. A link does not constitute our endorsement of that site.

14. Dispute Resolution
If you have a complaint or dispute, please contact us first at contact@stratumstone.com. We will make a genuine effort to resolve it within 10 business days.
If we cannot resolve the dispute directly, you may refer it to Consumer and Business Services (CBS) South Australia or the relevant consumer protection authority in your state or territory. You also have the right to pursue a claim through the courts.
For disputes involving amounts under $10,000, you may use the the South Australian Civil and Administrative Tribunal (SACAT) — a low-cost, accessible option for resolving consumer disputes.
15. Governing Law
These Terms are governed by the laws of South Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of South Australia for any dispute arising from these Terms, without prejudice to your right to bring proceedings in any other jurisdiction.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, Returns Policy, and Shipping Policy, constitute the entire agreement between you and Stratum Stone in relation to your use of this website and any purchase made through it.
